- Acceptance of Terms
- a) These terms and conditions, as amended from time to time, govern the provision and/or use of any goods and/or services provided by the registered company ‘‘GOAT CLUB PTY LTD’ (ACN: 658 935 043) (trading as “Goat Club”).
- b) Any use of the website, any goods or services of the Goat Club and any purchase of membership constitutes an agreement to and acceptance of the terms and conditions, as amended.
- c) Amendments to the terms and conditions may result in changes to the website and any goods or services or promotions that it offers. Amendments are effective when they are updated on the website and any members of the Goat Club or users of the website, goods or services agree to and are bound by those changes.
- Privacy
- a) The Goat Club is bound by and obtains, uses, and disseminates information in accordance with the Privacy Act 1988 (Cth).
- b) The Goat Club’s Privacy Policy, as amended from time to time, is published on its website.
- c) By agreeing to these Terms and Conditions, you also agree to your information being collected, used, and disseminated in accordance with the Privacy Policy.
- Goods and Services
- a) The Goat Club is membership program that offers discounted access to gaming and technology related merchandise, goods and services to members. Membership enables access to discounts, including exclusive discounts, from industry partners and from the Goat Club products and merchandise.
- b) Membership categories are as determined by the Goat Club from time to time, and subject to the conditions and rights attributed to that category as published on the Goat Club website. The Goat Club may determine some tiers of membership as ‘VIP Membership’ tiers, and may confer additional rights and benefits to VIP Members – including discounts and promotional benefits. The information regarding each membership, found here goatclub.com.au/sign-up, contains information about which memberships are VIP Memberships.
- c) The Goat Club also offers temporary membership ‘boosters’ which enable members to temporarily increase the benefits associated with their membership category. Boosters are offered by the Goat Club subject to such conditions and rights as determined by the Goat Club from time to time.
- d) The Goat Club reserves the right to add, remove, vary, substitute or discontinue any or all goods and services in its sole discretion at any time.
- e) The Goat Club may from time to time conduct promotional giveaways (Promotions). The conduct of Promotions will be in accordance with these terms and conditions, as well as any additional requirements stipulated for that Promotion.
- f) By entering a Promotion, you accept these terms and conditions and warrant that you meet the eligibility criteria of the Promotion.
- G-Cash
- a) VIP Members also have access to loyalty points known as ‘G-Cash’, which can be redeemed for rewards in the Goat Club Store.
- b) G-Cash is accumulated in accordance with the terms set out in the membership or subscription package that is purchased. That accumulation includes any allocation of points based on the subscription or membership benefits, as well as points accrued via the earn back system associated with purchases in the Goat Club Store. The rate of earn back is determined by the category of the membership package, with higher-value packages being associated with higher earn back rates.
- c) Only VIP Members may accumulate, hold and spend G-Cash. Any G-Cash held by a Member will be lost upon termination, cancellation or ending of the membership, or where the Member’s category of membership becomes ineligible to accumulate, hold and spend G-Cash.
- d) Goat Club may from time to time determine and vary the categories of membership that are VIP Members at its discretion.
- Terms of use
- a) As part of any registration for membership of the Goat Club, you may be asked to provide information including name, address, date of birth, mobile phone, email address and payment information. You agree that any information you provide is true and complete (both at the time of registration and on an ongoing basis) and agree that any failure to provide or maintain true and complete information is a breach of these terms and conditions. You agree to immediately update your account information in the event of any change in your circumstance
- b) You agree to notify the Goat Club immediately of any known or suspected
unauthorized access of your account or breach of security or your password.
The Goat Club is not responsible for any loss or damage where you have not maintained the confidentiality of your account. - c) The Goat Club reserves the right to take any reasonable steps, including restricting, limiting or terminating any account, in the event of a breach or suspected breach of these terms and conditions.
- d) The Goat Club may also limit or restrict any access to or use of any goods or services, Including the website, at its sole discretion without notice.
- e) All memberships and rights and property associated with the memberships, including promotion entries and G-Cash, are personal and may not be shared or transferred.
- f) You may cancel any membership or subscription at any time by logging into your Goat Club member portal and selecting ‘unsubscribe’ within the Account Billing tab of the dashboard, with such cancellation to take effect immediately. You are not entitled to any refund of any subscription or membership fee if you chose to cancel your service during any period of membership.
- g) You agree that Goat Club may charge your selected payment method for any recurring or scheduled payments for your membership or subscription. You may select and vary your payment methods from time to time by logging into your Goat Club membership portal and selecting ‘update card details’ within the Account billing tab of the dashboard. The Goat Club may suspend, cancel or refuse payment in the event of any suspicion of fraud or unlawful behaviour at its discretion.
- h) It is your responsibility to ensure your payment details are complete, accurate and that you are able to meet your financial obligations of membership.
- i) Following an initial failure to complete a payment for any membership or subscription, a further eight (8) attempts to process payment will be made at regular intervals over the course of the following one (1) month. Failure to make payment following the end of this period will result in automatic cancellation of the membership or subscription.
- j) Upon cancellation or termination of your membership or subscription, any and all rights and property associated with the memberships, including promotion entries and G-Cash, will expire on the effective date of cancellation or termination.
- k) You agree that in using any goods or services of the Goat Club (including the website) you will not:
- (I) violate any applicable law or regulation, including any infringement of copyright, trademarks or improperly use, obtain or disclose confidential or private information;
- (II) participate in any defamatory, harmful, or inappropriate conduct towards any person; or
- (III) participate or be knowingly involved in, directly or indirectly with, any
breach or attempted breach of any security of the confidential or private
information held by the Goat Club, including any account holders
information or software data.
- l) All communications, comments and submissions to the Goat Club in connection with any use of the website or any goods or services are the exclusive property of the Goat Club. In making any communication, comment or submission to the Goat Club you agree that the contents therein are assigned to the Goat Club to deal with in its absolute discretion.
- m) All users are solely responsible for any violation of the terms of use and of any relevant laws or third-party rights as a result of their conduct, and you indemnify the Goat Club for any loss or damage suffered in connection with any violation.
- n) Any and all services, content, information and products belonging to third party providers that may be available, advertised or featured on the Goat Club website or in any communications, are made without any representation or warranty by the Goat Club regarding those products.
- Consumer rights & obligations
- a) The Australian Consumer Law (ACL) requires businesses to provide consumer guarantees for goods and services that apply regardless of any warranty, and cannot be excluded
- b) For any minor problem with goods or services provided, the Goat Club Store choose at its discretion whether to remedy the problem by replacing, repairing or refunding a consumer.
- c) For any major problem a consumer can choose to obtain a full refund or replacement by returning any goods and services, or can keep the product and request compensation for the reduction in value of the product.
- Promotion Eligibility
- a) Unless specified otherwise, Promotions are open only to people who:
- (I) are residents of Australia; and
- (II) are 15 years of age or older; and
- (III) have completed all requirements from time to time that are specified for the Promotion.
(Eligible Person).
- b) Details of entry, prizes and drawing of each Promotion are detailed in the terms and conditions for that promotion.
- a) Unless specified otherwise, Promotions are open only to people who:
- How to Enter Promotions
- a) In order for an Eligible Person to be entered into a Promotion they must:
- (I) Purchase a membership to Goat Club; or
- (II)Continue a membership to Goat Club, during the applicable Promotion Period.
- b) When a person purchases a VIP membership package to the Goat Club, or any other such package offered by the Goat Club, that person also receives a pre-determined quantity of G-Cash, as well as an allocation of entries into Promotions, as set out in that tier package.
- c) When a person purchases or renews (including via any automated subscription) a membership to the Goat Club, that person receives a certain number of entries to each of active Promotion for that month of their membership, in accordance with the number
- d) For each further month that a person remains a member of Goat Club, that person will receive additional monthly entries into any Promotion conducted during that month, in accordance with the number of entries specified for the category of their membership. For example, a person who has been a member for three months of a category which receives one entry per month, will receive three entries for any Promotion taking place in the third month. A person who has been a member for three months of a category which receives three entries per month, will receive nine entries for any Promotion taking place in the third month, etc.
- e) Entries are automatically applied to any eligible Promotion. Entries are personal, non-transferrable, nor redeemable for cash or any other consideration.
- f) Entries must be received before the end of the Promotion Period to be eligible. The time of entry is the time the registration is received by the Goat Club. No responsibility is accepted by the Goat Club for any late, incomplete, or lost entries.
- g) By entering into the Promotion you agree that your information may be published as a winner as required by law and these Terms and Conditions.
- a) In order for an Eligible Person to be entered into a Promotion they must:
- Exclusions and Liability
- a) Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia.
- b) Except for any liability that cannot by law be excluded, the Goat Club (including its officers, employees and agents) is not responsible for and excludes all liability for any personal injury; or any loss or damage in the provision of any goods or services, the exercise of any rights in the provision of goods and services, or conduct of any promotion, whether direct, indirect, special or consequential, arising in any way out of:
- (I) any technical difficulties or equipment malfunction (whether or not under the Goat Club’s control);
- (II) any theft, unauthorised access or third party interference or intervention;
- (III) any addition, variation, substitution or removal of any goods or services provided by the Goat Club;
- (IV) any limitation or restriction of access to any goods or services provided by the Goat Club;
- (V) any exercise of any rights by Goat Club to suspend, terminate or vary rights of a Member in accordance with these Terms and Conditions;
- (VI) any entry or Promotion claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Goat Club;
- (VII) any failure, delay or defect with or related to any network, service of transmission (including by not limited to post, telephone or internet);
- (VIII) any variation in prize or prize value to that stated in the Promotion;
- (IX) any prizes damaged or lost in transit;
- (X) any tax liability incurred by a winner or entrant;
- (XI) use of any prize; or
- (XII) any other circumstances outside the reasonable control of the Goat Club.
- c) Where any event or occurrence outside of the control of the Goat Club prevents or hinders the ability to proceed with the Promotion or any part of it, the Goat Club may vary, cancel or re-schedule the Promotion or any part of it. any such action must be conducted in accordance with the applicable law and regulatory requirements for which the Promotion is conducted.
- Exclusions and Liability
- a) The headings in these Conditions are for convenience only and do not affect interpretation.
